These terms govern your use of vickybaey.com and any purchases you make from Vicky Baey. By using the website or placing an order, you agree to them. Nothing in these terms affects the mandatory rights you have as a consumer under Belgian and EU law.

1. Scope

These terms apply to the website vickybaey.com and to every order placed through it. They are available in English, French, Dutch and German. If you do not agree with them, please do not use the website or place an order.

Where a mandatory consumer protection rule gives you more rights than these terms, that rule prevails.

2. Seller information

We answer questions about orders, fit, delivery, returns and complaints through the contact form. Return and exchange requests are handled through the return request form.

3. Products

We describe and photograph our products as accurately as we can. Minor colour differences between the photographs and the item you receive can occur because of screen settings and lighting, and are not a defect.

Materials, sizing, fit and care instructions are shown on the product page. Sizing guidance is explained in our size guide.

We do not replace an ordered product with a different product without your consent.

4. Orders and contract formation

Product listings on this website are an invitation to order, not a binding offer. Before you pay, the checkout shows your order, delivery details and the final amount, and you can correct any information or cancel.

By completing checkout you make an offer to purchase. The automatic order acknowledgement you receive by email confirms that we received your order; it does not by itself mean that we have accepted it. The sales contract is formed when we confirm acceptance of your order, at the latest when we confirm that your order has been dispatched.

We may refuse or cancel an order for legitimate reasons, including stock unavailability, an obvious pricing or description error, failed or refused payment, an incomplete delivery address, or suspected fraud or misuse.

If we cancel an order you have already paid for, you receive a full refund of the amount paid, to the original payment method.

5. Prices and taxes

Prices are shown in euros and include applicable VAT unless clearly stated otherwise.

Available delivery options and their cost are shown before you confirm your order. The final amount payable, including delivery, is shown at checkout.

Promotional and discount codes apply only under the conditions stated with them, cannot be exchanged for cash, and may be limited in time or per customer. Obvious pricing errors do not oblige us to deliver at the incorrect price; if this happens we will contact you and you can confirm or cancel the order.

6. Payment

Payment is made at checkout using the payment methods shown there. Payments are processed securely by the payment providers connected to our checkout.

By paying, you confirm that you are authorised to use the selected payment method. We do not store complete payment card details ourselves; these are handled by the payment providers.

If a payment is refused, reversed or fails, we may suspend or cancel the order.

7. Delivery

Available destinations, estimated delivery times and delivery charges are set out on our Shipping & Returns page and confirmed at checkout.

Delivery times are estimates and are not guaranteed dates unless we have explicitly stated otherwise in writing. You are responsible for giving a complete and accurate delivery address and contact details.

Risk of loss or damage passes to you when you, or a person you designate other than the carrier, take physical possession of the products, unless applicable law provides otherwise.

8. Right of withdrawal, returns and exchanges

You may request a return or exchange within 14 days of receiving your order, under the conditions set out in full on our Shipping & Returns page. That page is the complete policy; these terms do not replace or shorten it.

Because our products are intimate garments, they are sealed for health and hygiene reasons. In line with the legal exception for sealed goods that are not suitable for return for reasons of health protection or hygiene, a return or exchange is not possible once the hygiene seal has been removed or broken. Items must otherwise be unworn, unwashed, with labels attached and in their original condition.

To start a return or exchange, use the return request form. Please wait for our instructions and return address before sending anything back.

This section does not affect your statutory rights if a product is faulty, damaged or not as described (see section 9).

9. Legal guarantee and conformity

As a consumer you benefit from the mandatory legal guarantee of conformity under Belgian and EU consumer law. If a product is faulty, damaged or does not correspond to what was described or ordered, you are entitled to have it repaired or replaced, or to an appropriate price reduction or refund, under the conditions provided by law.

This is a legal right, not an optional commercial warranty, and it applies free of charge. The hygiene conditions described in section 8 do not limit it.

If you think a product is not in conformity, contact us through the contact form or the return request form, with your order details and, where relevant, photographs.

10. Intellectual property

All content on this website — text, photography, illustrations, design, layout, trademarks, logos and the Vicky Baey brand — belongs to Vicky Baey or its licensors and is protected by intellectual property law.

You may view, browse and print pages of this website for your own personal, non-commercial use. Any other reproduction, distribution, modification, publication or commercial use requires our prior written permission.

11. Website availability and acceptable use

When using this website, you agree not to:

  • use it for any unlawful or fraudulent purpose;
  • place fraudulent orders or use a payment method you are not authorised to use;
  • attempt to disrupt, overload, damage or gain unauthorised access to the website or its systems;
  • use our content, trademarks or branding without permission.

We aim to keep the website available, but it may occasionally be unavailable because of maintenance, updates, technical issues or circumstances outside our reasonable control.

12. Liability

To the extent permitted by law, we are not liable for losses that were not reasonably foreseeable to both parties when the contract was concluded, or for business losses such as loss of profit, loss of business or loss of business opportunity arising from a consumer purchase.

Nothing in these terms excludes or limits our liability where it cannot legally be excluded or limited. This includes your mandatory consumer rights, the legal guarantee of conformity, liability for fraud or fraudulent misrepresentation, deliberate misconduct or gross negligence, and liability for death or personal injury caused by our negligence, where applicable.

13. Privacy and cookies

We process personal data as described in our Privacy Policy. Our use of cookies and similar technologies, and how to change your choices, is explained in our Cookie Policy — you can adjust your preferences at any time through the cookie settings link in the footer.

14. Complaints

If something is wrong, we would like to hear it first. Please send your complaint through our contact form, with your order details and a description of the issue. We aim to acknowledge complaints promptly and to find a fair solution with you.

If we cannot resolve your complaint together, you retain the right to bring the matter before the competent court or, where available, before a competent consumer mediation body.

15. Governing law and jurisdiction

These terms are governed by Belgian law. If you are a consumer residing elsewhere, you continue to benefit from any mandatory protections provided by the laws of your country of residence. Nothing in these terms limits any right you may have to bring proceedings before a court that has jurisdiction under applicable consumer law.

16. Changes to these terms

We may update these terms, for example to reflect changes to our products, our processes or the law. The version that applies to your order is the version in force at the moment you placed it. Changes are not applied retroactively to purchases already completed.

17. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue to apply in full.
